These Terms of Service (“Terms”) govern your use of chattasitan.com and your purchase of products from our website. The website and online store are operated by The Everest Pride LLC, trading as Chatta Sitan (“we,” “us,” or “our”).

By using our website or placing an order, you agree to these Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, which form part of these Terms.

Nothing in these Terms limits or removes any statutory consumer rights you may have under applicable law.

1. Acceptance of These Terms

By browsing chattasitan.com, creating an account, or placing an order, you agree to be bound by these Terms and our applicable policies.

If you do not agree with these Terms or our policies, please do not use the website or place an order.

2. Eligibility and Age

You must be at least 18 years old, or the age of majority in your place of residence, to create an account or place an order.

By placing an order, you confirm that:

  • You meet the applicable age requirement.

  • The payment method you use belongs to you or you are authorized to use it.

  • The information you provide is accurate and complete.

Our website and Services are not directed toward children.

3. Accounts

If you create an account, you are responsible for keeping your login credentials confidential and for all activity associated with your account.

You agree to provide accurate, current, and complete information and to update your information when necessary.

If you believe that your account has been accessed or used without authorization, please contact us promptly at support@chattasitan.com.

We reserve the right to suspend or terminate an account if we believe it has been used in violation of these Terms, our policies, or applicable law.

4. Products, Orders, and Pricing

We currently offer the Chicken Sitan Kit, a shelf-stable, ready-to-eat Nepali chicken and chiura pouch, in single, 3-pack, and 5-pack sizes. Products may be available as one-time purchases or recurring subscriptions.

We make reasonable efforts to provide accurate product descriptions, photographs, ingredients, and other product information. However, photographs are for illustrative purposes and packaging or product appearance may vary.

All prices are displayed in U.S. dollars unless otherwise stated. Shipping charges and applicable taxes or duties may be added at checkout.

We reserve the right to correct pricing, product description, availability, or other errors. If a product is listed with an incorrect price or material information, we may cancel or refuse the affected order, even after an order confirmation has been issued. If we cancel an order for this reason, we will notify you and provide a full refund of amounts paid for the canceled order.

We may refuse, limit, or cancel orders at our discretion, including orders that appear fraudulent, orders intended for unauthorized resale, or unusually large quantities.

Allergens and Product Suitability

Chicken Sitan Kit is a food product containing chicken.

Please read the ingredient, allergen, storage, and preparation information provided on the product packaging before consuming the product.

If you have a food allergy, dietary restriction, medical condition, or other concern regarding the suitability of the product, please review the product labeling and consult an appropriately qualified professional.

We do not provide medical, nutritional, or dietary advice.

5. Pre-Orders

One-time purchases of the Chicken Sitan Kit may be offered on a pre-order basis.

By placing a pre-order, you acknowledge and agree that:

  • Your payment method is charged when you place the pre-order unless otherwise stated at checkout.

  • We currently expect to ship pre-orders on or before September 30, 2026.

  • If we are unable to ship by that date, we will notify you by email and provide an updated estimated shipping date.

  • If we cannot fulfill your order, you may cancel it and receive a full refund of amounts paid.

  • You may request cancellation of a pre-order at any time before it is dispatched and receive a full refund of amounts paid, including applicable shipping charges.

  • Quantities in an initial production batch may be limited.

If circumstances prevent us from fulfilling an order, we will notify you and issue the applicable refund.

6. Subscriptions and Recurring Billing

We may offer the Chicken Sitan Kit through a weekly subscription. Subscription orders automatically renew until canceled.

Please review the subscription terms displayed at checkout before completing your purchase.

6.1 Subscription Terms

When you select a subscription, you authorize us or our payment provider to charge your selected payment method automatically on a recurring basis until you cancel.

The current subscription terms are:

  • Billing frequency: Weekly

  • Delivery frequency: Weekly

  • First delivery: September 1, 2026

  • Subsequent deliveries: Weekly following the first delivery

  • First charge: At the time you subscribe

  • Subsequent charges: At the beginning of each subsequent billing period

  • Subscription price: The price displayed for the selected subscription at checkout

  • Shipping and taxes: Any applicable shipping charges and taxes are displayed at checkout

  • Minimum term: None

  • Minimum number of deliveries: None

  • Cancellation fee: None

Subscription prices and terms may change as described below.

6.2 Canceling, Skipping, Pausing, or Changing a Subscription

You may cancel your subscription at any time without providing a reason or paying a cancellation fee.

You can manage your subscription using the subscription management link provided in your subscription or order emails, or through your account on chattasitan.com where available.

Depending on the options available for your subscription, you may also be able to:

  • Skip a delivery

  • Pause your subscription

  • Change the number of packs

  • Change delivery frequency

  • Change the delivery date

  • Update your payment information

  • Update your shipping address

You may also request cancellation by contacting us at support@chattasitan.com.

To avoid the next recurring charge, please cancel before the next scheduled billing date.

Canceling a subscription stops future recurring charges. It does not automatically refund an order that has already been charged, processed, or shipped. Refunds and returns are governed by our Refund Policy.

6.3 Subscription Notices

Where applicable, we may send an email reminder before a recurring subscription charge and shipment.

We will provide advance notice of material changes to subscription pricing or frequency where required by applicable law.

If you continue your subscription after the effective date of a notified change, the updated terms will apply from that date.

An order confirmation will be provided for recurring subscription charges.

6.4 Failed Payments

Please ensure that your payment and contact information remains accurate and current.

If a recurring payment fails, we may retry the payment and notify you by email.

If payment continues to fail, we may pause or cancel the subscription until the payment issue is resolved.

7. Payment

Payments are processed through our payment providers.

We do not store your complete payment card information on our own systems. For subscriptions, your payment method may be securely stored by our payment provider for the purpose of processing recurring charges.

You must use a valid payment method that you are authorized to use.

If a payment is declined, reversed, disputed, or charged back, we may cancel or suspend the applicable order or account until the issue is resolved.

8. Shipping and Delivery

Shipping destinations, rates, processing times, and delivery information are described in our Shipping Policy.

Our current shipping terms include:

  • One-time pre-orders are expected to ship on or before September 30, 2026.

  • Subscription deliveries are scheduled to begin September 1, 2026.

  • U.S. shipping is available to all 50 states.

  • Free U.S. shipping is available on qualifying orders over $35, as stated at checkout.

  • Orders below the free-shipping threshold may be subject to a flat shipping charge.

  • Canada is available at a flat shipping rate, with applicable duties and import charges payable by the customer.

  • We are currently not offering shipping to the United Kingdom, European Union, or Australia unless otherwise stated at checkout.

Delivery dates are estimates and are not guaranteed unless expressly stated otherwise.

Risk of loss and title generally pass to you when the carrier delivers the package to the shipping address provided with your order, subject to applicable law.

9. Returns and Refunds

Our Refund Policy explains our return and refund procedures, including our 30-day return policy, pre-order cancellation rights, damaged or incorrect items, and refund processing.

Where applicable, we may provide refunds without requiring a food product to be returned.

10. Acceptable Use

When using chattasitan.com, you agree not to:

  • Violate any applicable law or regulation.

  • Infringe the rights or intellectual property of another person or organization.

  • Submit false, misleading, or fraudulent information.

  • Impersonate another person or organization.

  • Post unlawful, defamatory, abusive, threatening, obscene, or hateful content.

  • Upload viruses, malware, or other harmful code.

  • Attempt to gain unauthorized access to our website, servers, systems, or other accounts.

  • Scrape, harvest, copy, or extract website content through automated means without our written permission.

  • Interfere with or disrupt our website or related systems.

  • Use our website to conduct fraudulent transactions.

  • Resell our products without our written authorization.

The website and its content, including text, product descriptions, photographs, graphics, logos, designs, page layouts, recipes, branding, and the Chatta Sitan name and brand, are owned by The Everest Pride LLC or its licensors and are protected by applicable intellectual property laws.

You may view and print pages from the website for your personal, non-commercial use.

You may not reproduce, distribute, modify, publish, sell, commercially exploit, or otherwise use our content without our prior written permission, except where permitted by law.

Customer Reviews and Content

If you submit a review, photograph, comment, testimonial, or other content to us, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, and publish that content in connection with our business, website, products, and marketing.

You represent that you own the content or have all necessary rights and permissions to grant us this license.

Without limiting any statutory consumer rights, we do not guarantee that:

  • The website will always be available or uninterrupted.

  • The website will be completely error-free.

  • Product descriptions, pricing, availability, or other website information will always be complete, current, or error-free.

Any statements regarding taste, enjoyment, nutrition, ingredients, or general wellbeing are provided for informational purposes only and are not medical advice or guarantees of a particular result.

13. Limitation of Liability

To the fullest extent permitted by applicable law, and without limiting statutory consumer rights that cannot legally be excluded:

We will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, business opportunities, or goodwill arising from your use of the website or purchase of our products.

To the fullest extent permitted by law, our total liability for any claim relating to a specific order will not exceed the amount you paid for that order.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.

14. Indemnification

To the fullest extent permitted by applicable law, you agree to indemnify and hold harmless The Everest Pride LLC, its officers, employees, agents, contractors, and service providers from claims, losses, liabilities, damages, costs, and reasonable legal expenses arising from:

  • Your breach of these Terms.

  • Your misuse of the website.

  • Your violation of applicable law.

  • Your violation of the rights of another person or organization.

  • Content you submit through the website.

This obligation will apply only to the extent permitted by applicable law.

15. Governing Law

These Terms and disputes arising from your use of chattasitan.com or purchases from us are governed by the laws of the State of Texas, United States of America, without regard to conflict-of-law principles.

This provision does not limit any mandatory consumer protections or statutory rights available to you under the laws applicable to your place of residence.

Where applicable law permits you to bring a claim in your local jurisdiction, nothing in these Terms prevents you from exercising that right.

We may update these Terms from time to time to reflect changes in our business, products, Services, legal requirements, or policies.

When we make changes, we will update the “Last Updated” date at the top of this page and publish the revised Terms on chattasitan.com.

Changes will generally apply from the date they are posted unless otherwise stated.

The Terms in effect when you place an order will generally govern that order, subject to applicable law.

Changes to subscription pricing or frequency will be communicated separately where required, as described in Section 6.

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later.

These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, constitute the agreement between you and us concerning your use of the website and your purchases.
